How to make employment relationship
The fixed-term contract is governed by article No. 59 of the Labor Code of the Russian Federation. It consists of: - to replace a temporarily absent employee;
- for the period of temporary work;
- when the company has up to 35 employees;
- with full-time students;
- with pensioners;
— when working in combination.If the term of the contract came to an end, and the employee continues working, the employment contract is renewed. When the contract expires, and the services of the employee are no longer needed, it warns three working days prior to the termination of the employment relationship.
The contract is considered to be concluded for an indefinite period, if the date of its termination is not specified.
The employment contract states: - Full name. an employee;
- passport details;
- TIN of the employer;
- information about the employer;
- place and date of conclusion of the contract;
- place of work of the employee;
- position and qualifications;
- type of work performed;
- date of commencement of work;
- mode of operation;
- social insurance.
Can be specified additional conditions. For example, the period of probation. It cannot exceed 3 months. If the probationary period is not specified, then work the employee will be without him. Not passed the probationary period warning 3 working days before the dismissal in writing.
The contract is made in duplicate and signed by the employee and the employer.
