How to give a work book
The employee must sign for the dismissal order. If he does not want to do this and refuses to sign, then the employer in the presence of two witnesses must draw up an appropriate act. Witnesses sign in the document, and after that a copy of the order is handed to the employee without fail. It is better to conduct this procedure in the presence of the employee.
Then the employee is given a work book, in which the reason for the dismissal, date and signature of the employer is inscribed. The dismissed person also signs in receipt of the book and takes it with him. The obligation to return the document is vested in the employer. If the employee is absent for any reason at work or is sick, the employer must returnthe book by any means within three days from the date of the issuance of the order.
The human resources department can forward the laborthe book by mail. In this case, the employee is sent a notice that he should come at a particular time and day to the address of the former place of work and pick up the document against the signature. To subsequently prove this action, you need to send a letter or telegram by registered mail with a notification. Having received a request from the work place that it is necessary to pick up the document, the employee must notify the employer in writing that he agrees to come or express his consent to the sending of the work book by mail.
If the dismissed person wants to be sent tothe book by mail, the employer needs to take into account that such documents are better to be sent by a valuable parcel or by registered mail with a notice. Thus, there will be a guarantee of safety of the document and its exact delivery to the addressee.
If the employee does not agree to wait for employmentthe book by mail, the employer must take measures for personal delivery. This can be done by visiting a worker's place of residence or calling him to a former job by telephone or internet. The employee may demand compensation for each day of delay in the issuance of the work record book. To avoid this, you need to prepare in advance for issuing the document and to prevent possible conflicts.
