How to withdraw an employee from vacation
To call an employee you need his consent. Forcing a call is illegal. The head of the company must issue a memo where the reasons for the withdrawal. Drawing up this document is not necessary, but in order to avoid problems with the tax authorities, it is better to compile it. The text of this document is something like this: “In connection with (state the reason), we ask you to interrupt your annual leave from (period). If you agree to this review, the unused portionholidays will be provided to you at a convenient time for you. "
After that, the employee can optionally write a statement of consent. Its text is approximately like this: “I agree with the recall from the annual paid leave on the terms of granting the unused part of the leave”.
Based on the above documents, the head of the organization draws up an order, which should include information about the reason for the revocation, as well as confirm the employee’s ability to use the remaining vacation days at any convenient time. The order is signed by the manager and the employee who is recalled from the leave.
It is also necessary to include information about the recall in the employee's personal card, where in section 8 you must specify the leave period, the type and number of calendar days.
Then the accountant of the organization must make changes to the vacation schedule (Form T-7), as well as on the basis of an order to perform recalculation. The amounts paid earlier for the leave must be returned by the employee to the company's cash office. The offset of these amounts in favor of wages is illegal, since the Labor Code of the Russian Federation does not provide for this. From the day the employee leaves for work, wages must be charged.
