How to recall a worker from vacation
To call an employee, his consent is necessary. Forced call is illegal. The head of the enterprise must issue an official memo, which specifies the reasons for the recall. The preparation of this document is not necessary, but in order to avoid problems with the tax authorities, it is better to compile it. The text of this document is something like this: "In connection with (indicate the reason) we ask you to interrupt your annual leave from (period). If you agree to this review, the unused portionvacations will be given to you in a convenient period for you. "
After this, the employee can, at will, write a statement of consent. His text is approximately the same: "With a recall from the annual paid vacation on terms of granting an unused portion of the leave I agree."
Based on the above documents, the head of the organization makes an order that should include information on the reason for the revocation, and also confirm the employee's ability to use the remaining days of vacation at any convenient time. The order is signed by the head and recalled from the vacation by the employee.
It is also necessary to include information about the recall in the employee's personal card, where in section 8 it is necessary to specify the period of leave, type and number of calendar days.
Then the accountant of the organization should make changes in the schedule of holidays (form T-7), and also on the basis of the order to carry out the recalculation. The paid sums earlier for leave should be returned by the worker in cash department of the enterprise. The offset of these amounts in favor of wages is illegal, since the RF LC is not provided for this. From the day the employee leaves for work, wages must be added.
