How to count the number of days of vacation
According to the Labor Code of the Russian Federation of December 30, 2001 №197-ФЗ, each employee has the right to annual paid leave with retention of a post and wages. It must be 28 calendardays. There is also an annual additional paid vacation, provided the categories of employees who work in harmful or dangerous labor conditions, as well as having long working hours. Additional leave is granted in the far North and equated localities. The duration of leave is calculated in calendar days.
Holiday days included in vacation, in the number of calendardays holidays are not included. The length of work that affects the duration of leave includes:
- days of actual stay in the workplace;
- Weekends and holidays;
- forced absenteeism (time of suspension from work for any valid reason);
Calculation procedurequantitydays vacation:
With a vacation of 28 calendardays For each month during the year, there are 2.33 calendar days of leave. This figure is obtained by dividingdays leave (28) forquantity calendar months (12). It should be borne in mind that Rostrud can round off the vacation to integers in a larger direction. It turns out that for each month of work from the time of hiring, the employee receives 2.33 vacation days.
By mutual agreement by the employer and the employee, annual paid leave can be divided into parts, but one of them must not be less than 14days. According to Article 136 of the LC RF calculation and payment of leave is calculated not later than threedays before it starts.
