How to conduct layoffs
Once you have made the decision on reduction of staff units, issue an order to the personnel Department. It will list the name of job and date of reduction.
Next, make a notice of the reduction of staff in the employment center in your district. Mention the position, job requirements for employees, the wage for each redundant employee. Make a notice in duplicate, one of which will remain in the employment center, and the second marked – you. Note that you can file this application have two months before the reduction, and if you reduce more than 15 people for three.
Then notify the employee of the impending termination of the contract. In the letter specify a date reductions, the reason. Remember that you need to notify not later than two months before the dismissal.

If the employee refuses to sign, i.e., disagree with the upcoming reduction – make the act of refusal. Note that you can not cut, pregnant women, mothers on maternity leave, single mothers and other categories of workers under the labour law.
After two months, you have to prepare documents for dismissal. First, pay the employee all unpaid wages for the period worked, compensation for unused vacation, severance pay that is equal to the average monthly wage.
Then make an order for the termination of the employment contract, referring to article 81 of the Labour code. Then enter the information in the workbook is an employee, do it the phrase "laid-off staff of the organization, paragraph 2 of part 1 of article 81 of the Labour code of the Russian Federation".
Don't forget to also approve the new staffing structure. And to make the information in the personal card of the worker, that is to put a note of resignation.
