How to dismiss a man for absenteeism
Make an arbitrary act of violation of labor discipline. In the document, issued on the day of truancy, reflect the following information:
- place, date of the act;
- positions, surnames and initials of the person who drafted the act, as well as similar information about two or more witnesses to the violation of labor regulations;
- a description of the violation itself (absence of the perpetrator in the workplace for at least 4 consecutive hours);
- verbal explanations provided by the offender;
- signatures of all persons involved in the drafting of a violation.
If the perpetrator refuses to sign the act, be sure to write about it in this document and verify the signatures of the witnesses.
Ask an employee who has missed to write an explanatory note stating the reasons for the misconduct. Please note that in the case of an appeal dismissed under the article “absenteeism” in the labor dispute commission, representatives of this organization with particular bias consider the importance of the reasons for absenteeism.
In the case of an employee’s refusal to give written explanations, draw up an act in a free form. At least two witnesses for failure.
Write a memo addressed to the head of the organization, general director, or other authorized person. Indicate in it the composition of the violation and attach all the necessary documents.
Prepare a draft order on imposing a disciplinary punishment on an employee. In the descriptive part of the order indicate the fact of violation of labor discipline by the employee, referring to the attached documents. In the order part write down instructions on non-payment of the working days that were missed without a valid reason, and also reflect the fact of issuance of a subsequent order on termination of the employment relationship with the employee.
Make a draft order of dismissal in accordance with subparagraph "a" of paragraph 6 of part one of Article 81 of the Labor Code of the Russian Federation.
After the two orders have been signed by the manager or his substitute person, make an entry about the dismissal in the employee’s personal card and in the work record.
Within three days, familiarize the dismissed employee with the texts of orders, if necessary, issue copies of all completed documents. On the day of the dismissal, issue a work record for the dismissed employee.
