How to dismiss a person for absenteeism
Compose in an arbitrary form an act on the violation of labor discipline. In the document issued on the day of absenteeism, reflect the following information:
- place, date of drawing up of the certificate;
- Positions, surnames and initials of the person who drafted the act, as well as similar information about two or more witnesses of violation of the labor regulations;
- description of the violation itself (absence of guilty person in the workplace for at least 4 hours in a row);
- verbal explanations provided by the offender;
- signatures of all persons involved in drawing up the act of violation.
If the culprit refuses to sign the act, then be sure to write about it in this document and certify with the signatures of witnesses.
Ask the employee who committed absenteeism to write an explanatory note specifying the reasons for the misconduct. Please note that in case of an appeal filed under the article "absenteeism" in the Labor Disputes Commission, representatives of this organization with special prejudice consider the importance of the reasons for absenteeism.
If the employee refuses to give written explanations, draw up an act in free form. Involve at least two witnesses.
Write a memorandum addressed to the head of the organization, the general director, or other authorized person. Specify in it the composition of the violation and attach all the necessary documents.
Prepare a draft order to impose a disciplinary penalty on the employee. In the narrative part of the order, indicate the fact of violation of labor discipline by the employee, referring to the attached documents. In the order part, write down instructions on non-payment of missing working days without good reason, and also reflect the fact of issuing a subsequent order to terminate the employment relationship with the employee.
Draft a draft of the dismissal order in accordance with subparagraph "a" of clause 6 of part one of Article 81 of the Labor Code of the Russian Federation.
After signing two orders by the head or a substituting person, write a note about the termination in the employee's personal card and in the work book.
Within three days, familiarize the dismissed employee with the texts of orders, if necessary, issue copies of all issued documents. On the day of dismissal, issue a work book to the dismissed employee.
