How to fire an employee for absenteeism
Make in any form an act of violation of labor discipline. The document, issued on the day of absence reflect the following information:
place, date of act
— position, surname and initials of who made the act, as well as similar information on two or more witnesses to violations of labor regulations
— a description of the violation (lack of workplace culprit for at least 4 consecutive hours)
— verbal explanations provided by the infringer
— the signatures of all persons involved in the drafting of the act of violation.
If the perpetrator refuses to sign the act, be sure to write about it in this document and ascertain the signatures of the witnesses.
Require the employee guilty of truancy, to write an explanatory note stating the reasons of misconduct. Note that in case of appeal is dismissed under article "truancy" in the labor dispute Commission, representatives of the organization with a special predilection considering the importance of the causes of truancy.
In case of refusal of the employee to provide a written explanation for a report in a free form. Attract at least two witnesses of the refusal.
Write a memo to the head of the organization, the Director-General, or other authorized person. Specify the composition of the violation and attach all the necessary documents.
Prepare a draft of the order on imposition on the employee of disciplinary action. In the descriptive part of the order specify the violation by the employee of labor discipline, referring to attached documents. Fiat parts, write down instructions about non-payment of missed unexcused working days, and reflect the fact of publication of the subsequent order of termination of the employment relationship with the employee.
Make a draft of the order of dismissal under the subparagraph "a" of paragraph 6 of part one of article 81 of the Labour Code of the Russian Federation.
After signature by the Manager or an equivalent person of the two orders, make entry of dismissal in a personal card of the employee and in the work book.
Within three days of the employee familiarize with the texts of the orders, if necessary, issue copies of all executed documents. Day release grant under the painting workbook at the hands of a dismissed worker.
