Tip 1: How to apply for an employee without labor
Depending on the purpose for which you are attracting a specialist. For example, if you need a person for one-time work to create an object of copyright (literary, musical and other artistic or non-artistic work), the cooperation is formalized according to the contract of the author's order or the author's license agreement.
For one-time works or permanent cooperation without formalizing the staff, you can also conclude a work contract or, for example, an agency contract. The term of its validity is usually limited, but if necessary, it may expire many times.
The text of the standard contract of the required type can be found on the Internet without difficulty. However, it will not be superfluous to study it carefully, to compare it with the situation of the current legislation, to make corrections, where necessary.
Particular attention should be paid to sections concerning the work performed, the requirements of the customer, the procedure for receiving and evaluating the results, possible sanctions for certain incidents.
Develop them better independently, based on the specifics of the activities, corporate rules and their vision of cooperation.
Enter the necessary data into the contract in the required places (the introductory part and the section on the addresses and requisites of the parties): the name of the organization, the name of its representative signing the contract (usually the manager) and the document on which basis it acts (company charter or power of attorney), legal and the actual (if any) address with indexes, TIN, OKVED main type of activity, bank details.
Fields that should be filled by the other party, leave blank, but specify in them the information that is required fromemployee. This is the surname, name and patronymic, passport data (series, number, by whom and when issued), address of registration, address of actual residence, if available, TIN, pension insurance certificate number, bank details for remuneration transfer.
Print out the contract in duplicate and give to the other party for review and signature.
Then sign it yourself and seal both copies. One remains with you, the second you give to the employee.
The contract is concluded.
