Tip 1: How to get an employee without labor
Depending on the purpose for which you attract a specialist. For example, if you need a person for a one-time work on the creation of a copyright object (literary, musical and other artistic or non-artistic works), cooperation is arranged under an author's order agreement or an author's license agreement.
For one-time work or continuous cooperation without registration in the state, you can also enter into a contract or, for example, an agency agreement. Its validity is usually limited, but if necessary, after its expiration, it can be renewed countless times.
The text of the standard contract of the desired type can be easily found on the Internet. However, it would not be superfluous to study it carefully, to compare it with the provision of current legislation, to make corrections where you see fit.
Particularly noteworthy are the sections relating to the work performed, the customer’s requirements for it, the procedure for accepting and evaluating the results, and possible sanctions for certain provinces.
It is better to develop them independently, based on the specifics of the activity, corporate rules and your vision of cooperation.
Fill in the contract in the right places (introductory part and the section on addresses and details of the parties) your necessary data: the name of the organization, the name of its representative signing the contract (usually the head) and the document on the basis of which it is valid (company charter or power of attorney), legal and actual (if available) addresses with indices, TIN, OKVED of the main type of activity, bank details.
Fields to be filled by the other party, leave blank, but indicate in them the information required fromemployee. These are surname, name and patronymic, passport data (series, number, by whom and when issued), registration address, address of actual residence if available, TIN, pension insurance certificate number, bank details for transfer of remuneration.
Print the contract in duplicate and give the other party for review and for signature.
Then sign and seal both copies. One remains with you, the second is given to the employee.
The contract is concluded.
